Connect to the inception

  • The Special Police Establishment set up in 1941
  • A Central gov Police force, headquarters at Lahore, set up by gov to investigate bribery and corruption in transactions with the War and Supply Department of India
  • Later on it transferred to Home Department by Delhi Special Police Establishment Act 1946
  • The founding director of CBI D.P. Kohli saw the potential in Special Police Establishment to grow into a National Investigation Agency
  • Scope enlarged to cover all departments of Government of India

Responsibility and duty of CBI

  • The CBI is headed by Director who is assisted by a special director or an additional director
  • The CBI has dual responsibility to investigate grievous cases and provide leadership and direction in fighting corruption to the police force across the country
  • Role in prevention of corruption and maintaining integrity in administration
  • Investigating in crimes such as murder, kidnapping and terrorism
  • Assists Central Vigilance Commission and Lokpal

Jurisdiction of CBI

Central government may extend its jurisdiction to any area, with the consent of State government

The SC and HC can order CBI to investigate without the State’s consent

Exempted from RTI –

Government of India Along with NIA, DGI-T and Natgrid, CBI is exempt from RTI

Appointed by a committee PM, Leader of opposition , CJI or such Judge (views of outgoing Director also considered)

  • The Director is responsible for the administration of the organization
  • The tenure security of 2 years provided by the CVC act of 2003
  • Under CVC Act 2003, superintendence of Delhi Special Police Establishment vests with Central government
  • Except investigations under PCA 1988, in which superintendence is with CVC

Criticism

  • Criticised for being a ‘caged parrot speaking in its masters’ voice’
  • Charges of Corruption, wrongful persecution, nepotism and corruption
  • Political interference
